INTERNATIONAL FEE PAYING STUDENTS POLICY

RATIONALE

The school will provide a New Zealand educational experience for a limited number of international students each year and in doing so will promote further opportunities at our school for people from diverse cultures to work alongside each other and enhance their understanding of each other’s culture.  Full compliance with The Code of Practice for the Pastoral Care of International Students is a key aspect of our International Students programme.

PURPOSES
1. To ensure that the enrolment of international fee paying students is well controlled.
2. To ensure that The Code of Practice for the Pastoral Care of International Students is complied with.
3. To ensure that international fee paying students gain the same educational opportunities as do full time New Zealand students.
4. To ensure that the administration related to international fee paying students is efficient.

GUIDELINES

An International Students Director will be appointed and they will have overall responsibility for:
i. Enrolment of international students (includes selection, “offer of place”, collection of fees).
ii. Orientation of international students.
iii. Pastoral Care/Course of Study of International students (in consultation with the appropriate Deans and form teacher).
iv. Keeping accurate records on all International students.
v. Liaison with recruitment agents.
vi. Handling complaints from international students.
vii.Preparing an annual report to the Board of Trustees.

The Board of Trustees will annually set the fees payable by international students.  Fees, protection and refund procedures statements are to be included in the International Students Handbook.
The Board of Trustees will annually determine the budget for the international students programme as part of the overall school budget.  This will include promotions/recruitment initiatives.
The Principal will, in consultation with the International Students Director, organise the production of an International Student’s Handbook that is reviewed annually.
The Principal will lead an annual review of procedures/practices associated with our international students programme to ensure that the school is fully compliant with all legal requirements for such programmes.  This process will also monitor and review our performance against the code to ensure ongoing code compliance.

SELECTION PROCEDURES FOR INTERNATIONAL STUDENTS

The Board of Trustees will annually set a desired maximum number of students for its international students programme.

The following will also be considered when decisions are made by the International Students Director as to whether or not an application is successful:

1. Country of origin The school will attempt to provide places for students from a diverse range of countries.

2. Age Preference will be given to students in the 10 - 13 age bracket.

3. English ability No minimum English requirement will be set

4. Academic ability 
Preference will be given to students who are likely to make a positive contribution to our school.

INTERNATIONAL STUDENTS
MEDICAL AND TRAVEL INSURANCE PROCEDURE

RATIONALE:
Papatoetoe Intermediate School   has developed a Medical and Travel Insurance Procedure –
• To ensure the safety, well-being of the students studying at Papatoetoe Intermediate School
• To ensure compliance with the Ministry of Education’s Code of Practice for the Pastoral Care of International Students (2003) (The Code of Practice).

Procedure Requirement Advice

1. All students are required to have appropriate Medical and Travel Insurance as specified in The Code of Practice. 
2. The school shall advise all prospective students about Medical and Travel Insurance requirements in the standard wording in the prospectus and with the Offer of Place letter.
3. Students purchasing insurance through a New Zealand insurer should purchase insurance cover at the time of fee payment and before they travel to study at  Papatoetoe Intermediate School.
4. Where insurance is provided from a New Zealand company policy details should be provided in the student’s first language where possible.
5. In the case of overseas policy providers students must provide Papatoetoe Intermediate School with the policy details in English at least one month before the students travel to New Zealand

Verification of Policies

Papatoetoe Intermediate School will verify groups are in receipt of an acceptable Medical and Travel Insurance coverage.

Verification of Insurance policies will be undertaken by the Director of International students prior to enrolment.

1. As part of the verification process, Papatoetoe Intermediate School shall ensure that:
• The insurer/re-insurer is a reputable and established company with substantial experience in the Travel Insurance business, and has a credit rating no lower than A from Standard and Poors, or B+ from A M Best.
• The Insurer is able to provide emergency 24-hour, 7 day per week cover.
• Students have a “certificate of currency” and policy wording from the Insurance company stating that the student has purchased the cover for the duration of the planned period of study. The certificate and policy working must also detail medical sums insured, repatriation benefits etc.

Where a student is not in possession of an appropriate and current medical and travel insurance policy
Papatoetoe Intermediate School undertakes to:
• Advise the student of the medical and travel insurance requirement.
• Not accept the enrolment until the correct medical and travel insurance coverage has been obtained.

Recording of Policy Details
For each student Papatoetoe Intermediate School shall record the:
a. Name of the Insurer
b. Policy number
c. Policy start and end dates.


Policy Renewals

For each student, prior to the expiry of their medical and travel insurance policy, Papatoetoe Intermediate School shall issue a written reminder to the student advising that policy renewal must be completed.

ACCOMMODATION POLICY FOR INTERNATIONAL STUDENTS

Papatoetoe Intermediate School undertakes to comply with the accommodation provisions set out in Part 6 of the Ministry of Education Code of Practice for the Pastoral Care of International Students.  The categories of accommodation that will be accepted by the school are:

i) Living with a parent
ii) Living with a designated caregiver
iii) Living in homestay – in an emergency only

POLICY OBJECTIVES
1. To ensure that students have a suitable living environment conducive to study and a safe and supportive home life.
2. To assist the student to successfully integrate into the New Zealand lifestyle.
3. To involve designated caregivers in the life of the school
4. To ensure that parents of students living with designated caregivers are kept informed of the welfare of their son or daughter at all times.

PROVISION OF ACCOMMODATION
Papatoetoe Intermediate School does not arrange accommodation for international students.   Homestay accommodation will only be arranged if there is an emergency and the designated caregivers are no longer able to provide satisfactory and/or safe accommodation for the student.    The school has a Contract with Kate Roberts from Student Care New Zealand [2010] Ltd. to find suitable emergency homestay accommodation.

ADMINISTRATIVE REQUIREMENTS AND UNDERSTANDINGS
General
1. All accommodation queries and issues will be dealt with by the Principal or the Director on International Students.  Pastoral care issues or concerns arising from accommodation arrangements will be referred to the Principal.
2. For each student, the full name, current address, contact phone number, occupation and relationship to student of the residential caregiver will be held.
3. Any serious concerns relating to accommodation will be reported to the Code Administrator.

EMERGENCIES
Papatoetoe Intermediate School will be responsible for:
• Providing a 24/7 emergency contact person for international parents and students to contact in the event of an emergency.

EVALUATION
Daya Prasad will provide an annual report on parental accommodation of international students to the Board of
Trustees in the Annual Report.

ACCOMMODATION PROCEDURES

On enrolment of each student, the school will:
1) Keep a record of the parent’s full name, current address, contact phone numbers and occupation.
2) Photocopy and keep a record of both the parent’s and the student’s Passport details, including expiry dates of visas and/or Student Permits.


STUDENTS LIVING WITH PARENT/S
Students in Years 7 – 8 (who are enrolled as living with a parent) must live with and continue to live with a parent/s for the duration of their studies at Papatoetoe Intermediate School.   The school will take a photocopy of both the student’s and the parent’s passport and visa details.

MONITORING:
In order to ensure that these international students are living with and continue to live with a parent for the duration of the student’s study in New Zealand, the school will meet once a term with international parents to ensure they are still living in the country.    If the school becomes aware that the parent of an international student has returned home, the school will endeavour to contact the parent and request that he/she return to New Zealand.   If the parent does not return to New Zealand within the time specified, the school will terminate the Enrolment Contract and the student will be returned to their home country at the parents’ expense.   The school will notify the New Zealand Immigration Service that tuition has been terminated and the student’s visa will be revoked.

EMERGENCIES:
In the event of an emergency, international parents may return home for a period of up to three weeks, provided they have informed the school in advance.   The school requires evidence of the emergency (i.e. a doctor’s certificate) and must sight a return air ticket.   The school will also visit and approve the alternative accommodation arrangements for the student to ensure that it is satisfactory.   If the parent fails to return within three weeks, the enrolment contract will be terminated and the student returned home, at the parent’s expense.  The school will notify NZIS that the student’s enrolment contract has been terminated.

YEAR 7 & 8 STUDENTS LIVING WITH A DESIGNATED CAREGIVER
Students in Years 7 & 8 may live with a relative or close family friend designated by the parent/s, subject to the approval of the Ministry of Education.    All accommodation and designated caregivers must be approved by the school, as required by the Code of Practice for the Pastoral Care of International Students.  For students in Years 7-8 who are living with a designated caregiver chosen by their parents, the school will:

• Check that parents of each student living with a designated caregiver have signed an Indemnity
Document, which declares that the designated caregiver is a relative or close family friend.
• On or before enrolment, will visit the home of the designated caregiver to ensure that it is suitable and
is not a Boarding Establishment – i.e. has five or more international students.
• On or before enrolment, will meet and establish communication with the designated caregiver.
• May police vet designated caregivers if it is thought necessary.


EMERGENCY HOMESTAY ACCOMMODATION
In a school approved homestay in an emergency only.   If the school finds that the designated caregiver accommodation is not satisfactory, the student will be removed from the home and placed in temporary accommodation, until such time as the parent either comes to live in New Zealand or the student is returned home.   The school has contracted Jenny Pickering of Top Class Homestays to find emergency homestay accommodation if needed.

 

DIVISIONS OF RESPONSIBILITY
Papatoetoe Intermediate School
Papatoetoe Intermediate School  will be responsible for:
• Providing a 24/7 emergency contact person for problems with accommodation.
• Approving and monitoring all designated caregiver accommodation.
• Recording the results of all accommodation assessment visits.
• Recording the results of all quarterly student interviews.

Caregivers
Papatoetoe Intermediate School  will expect all designated caregivers to:
• Provide a safe and friendly living and studying environment.
• Provide day to day care including:
- 3 meals a day and access to snacks
- own room
- bed and bedding
- study desk and chair
- adequate bedroom furniture to store clothes, books etc.
- lamp and adequate lighting
- adequate heating
- transport arrangements to and from school
- bathing/showering/bathroom access
- laundry
• Treat the student with respect.
• Make the student feel comfortable and part of the family.
• Notify the school if there are any changes or additions to the household.
• Notify the school immediately if there are any problems with the student. e.g medical condition, misconduct.
• Notify the school immediately if the student seems very homesick or depressed.
• Look after the student in their home to the best of their ability.

Host Families will not be expected to:
• Provide an internet connection for the student.
• Pay for toll or mobile phone calls.
• Cook special food.
• Insure the student’s goods or pay for property the student damages or loses.
• Offer accommodation to visiting friends or relatives.
• Comply with unreasonable requests.

Checklist for Selecting approving and Monitoring Student Accommodation
TASK COMPLETE
1. Designate a resource person or unit for accommodation

Annual Review of compliance with the Code of Practice for the Pastoral Care of International Students.

Papatoetoe Intermediate School  will conduct an Annual Review of all procedures and policies related to compliance with the Code of Practice for the Pastoral Care of International Students in order to ensure that Papatoetoe Intermediate School is up to date with all existing and new Code requirements.

The Director Daya Prasad ensures that there is co-ordinated record-keeping of:
i)  Academic progress    ii)  Student grievances   
iii) Accommodation issues   iv) Student welfare

• Statistics on these are collated and reported on to the by the Director Daya Prasad regularly.

This review will be carried out as follows:

Ongoing compliance with the Code at Papatoetoe Intermediate School  will include:
• Feedback from all staff and students involved in the programme
• An evaluation of performances against the goals and objectives
• Analysis of results of external/internal examinations
• Analysis of international academic progress at the end of each term.
• Feedback from ESOL teachers, classroom teachers and the pastoral carer of international students (including social progress and integration) to the Principal
• Use of data from accommodation conferences and ongoing monitoring of international student accommodation as per the school’s accommodation policy.

All Code compliance information is reported to the Board of Trustees, annually, at the end of Term 3 each year.

Dr Brian Hinchco] is responsible for organising this Review.

Daya Prasad will be familiar with the provisions of the Code of Practice for the Pastoral Care of International students and the Guidelines to support the Code.  Dr Brian Hinchco is responsible for ensuring that the school is compliant with the Code on an ongoing basis.

Daya Prasad is responsible for checking the Ministry website updates.

Daya Prasad will remain up to date with all Code amendments through the Ministry of Education/Code of Practice website, which can be viewed at: www.minedu.govt.nz/goto/international

Dr Brian Hinchco is responsible for approving changes to policies and procedures.

• Any changes will be filed with the Code Administrator to ensure ongoing compliance
• The resetting of goals and objectives will be done in conjunction with the staff of Papatoetoe Intermediate School

Dr Brian Hinchco is responsible for ensuring implementation of policy and procedures and updating the School’s website?

Dr Brian Hinchco] and Daya Prasad for International Students will ensure that staff are appropriately informed of their obligations under the Code and that all changes in policies and procedures are implemented and updated as needed.

Dr Brian Hinchco is responsible for providing the Code Administrator (i.e. Ministry of Education) with an annual update and assurance statement of Code compliance.

Daya Prasad is the person responsible for ensuring that all review outcomes are recorded in a form that can be made available to the Administrator on request.

Tuition Contract

AGREEMENT TO PROVIDE TUITION SERVICES  BETWEEN

PAPATOETOE INTERMEDIATE SCHOOL AND THE PARENTS OF:

1. The Parent has made application for tuition of the Student in New Zealand and wishes the Student to attend Papatoetoe Intermediate School.

2. The School has agreed to enrol the Student upon and subject to the terms and conditions hereinafter set out.

The School’s Obligations
3. The School will observe and be bound by the Ministry of Education’s Code of Practice for the Pastoral Care of International Students (“Code”).  Copies of the Code are available on request from the school or from the Ministry of Education website at http://www.minedu.govt.nz/goto/international
3.1. The School shall provide tuition in accordance with that accorded to domestic students

3.2. The School will only accept International Students who live with their parents, relatives or close family friend (designated caregiver).  Homestay will be considered as an emergency option.

4. The School shall use its best endeavours to ensure the safety, health and well-being of the Student but shall not be liable for:
4.1. Any damage or harm caused to the Student or the Student’s property while attending the School
4.2. Any damage or harm caused to the Student or the Student’s property arising out of the Student’s accommodation
4.3. Any damage or harm caused to the Student or the Student’s property outside normal school hours.  In the case of the Student’s property, shall not be responsible for any damage to such property  that may occur outside the school premises.

The Parent’s Obligations
5. The Parent shall:
5.1. Pay to the School the tuition fees in the manner agreed to by both parties
5.2. Agree to provide the school with academic, medical or other information relating to the well-being of the Student as may be requested from time to time by the school
5.3. The student will accept and abide by the school’s rules and all instructions given by members of staff.
5.4. The students will attend school on all occasions when it is open unless prevented by illness or other urgent cause.

Authorisations
6. The parents of the Student who have signed the application for tuition on behalf of the Student irrevocably appoint and authorise the Principal of Papatoetoe Intermediate School (or such other person as may be appointed by the Board of Trustees of the school) to:
6.1. Receive information from any person, authority or corporate body concerning the Student including, but not limited to, medical, educational or welfare information.
6.2. Provide consents in respect of any activity carried out and authorised by the school.
6.3. Provide consents that may be necessary to be given on the Student’s behalf in the event of a medical emergency where it is not reasonably practicable to contact the Applicant.
6.4. If applicable, advise the Student’s Designated Caregiver of all matters and information required to be provided to parents of any student and agree to appoint the Designated Caregiver as their agents in New Zealand to receive such information in substitution for the Applicant.
6.5. To take whatever steps are necessary to ensure the Student complies with School rules and policies as set down by the School.
6.6. To obtain at any time from any person or entity any information required to process and/or accept the application for tuition or to perform or complete the School’s various obligations under this agreement.  The Applicant authorises any such person to release to the School and personal information that person holds concerning the Student/Applicant.

Limitations of Liability
7. In no event shall the School’s liability exceed an amount equal to the amount of tuition fees paid by the Applicant.

Termination
8. Either party may terminate this agreement with 5 (five) days written notice

9. Upon termination of this agreement, refunds will be made in accordance with the School’s Refund Policy.

Miscellaneous
10. Nothing in this agreement limits any rights the Applicant and/or the Student may have under the Consumer Guarantee Act 1993

11. It is acknowledged that the stand-down, suspension and exclusion of students provisions as set out in Part II of the Education Act 1989 shall apply to the Student in New Zealand.  Any decision under these provisions to stand-down, suspend or exclude the Student shall terminate this agreement and the refunds policy will apply.  The parents will have no claim for damages for any compensation if this agreement is terminated in these circumstances.

12. Force majeure: Neither party shall be in default or in breach of their obligations under this agreement to the extent that the performance of those obligations is prevented by an event of force majeure.  Force majeure means an event beyond the reasonable control of the party seeking to rely on force majeure.

13. Governing Law: This agreement shall be construed and take effect in accordance with the domestic laws of New Zealand.  In relation to any legal action or proceedings arising out of or in connection with this agreement the Applicant irrevocably submits to the exclusive jurisdiction of the Courts of New Zealand, and agrees that proceedings may be brought before any court including any forum constituted under the Arbitration Act 1908 within New Zealand and waive any objection to proceedings in any such court or forum constituted under the Arbitration Act 1908 within New Zealand on the grounds of venue or on the grounds that the proceedings have been brought in an inconvenient forum.

Entire Agreement
14. This agreement shall consist of:
14.1. The application for tuition in New Zealand;
14.2. The Tuition Agreement including any Schedules annexed thereto (including the refund and fee protection policies and the International Student Information Booklet).

15. This agreement contains the entire understanding of the parties and overrides any prior promises, representations, understandings or agreements.

16. The terms of this agreement may be changed at any time by the School in writing to the applicant and any such change in terms shall be notified to the Applicant in writing.
16.1. Notices given in writing will be given to the addresses set out in the application forms.  Those sent by post shall be deemed to have been received 5 (five) days after posting.

The Privacy Act
17. The Parent acknowledges that:
17.1. Personal information of the Parent and/or Student collected by the School and may be held, used and disclosed to third parties to enable the School to:
17.1.1. Process the application for tuition
17.1.2. Provide tuition to the Student
17.1.3. Provide the Student and/or Parent with advice or information concerning products and services the School believes may be of interest to the Student and/or Parent; and
17.1.4. To enable the School to communicate with the Student and/or Parent for any purpose.
17.2. All personal information provided to the School will be held by the School at Papatoetoe Intermediate School, 175 Motatau Road Papatoetoe Auckland. Tel: 09 278 9763, Fax: 09 279 8288..  Failure to provide any information in the application for tuition may mean the School is unable to process the application.
17.3. The Student and Parent/s have the right under the Privacy Act 1993 to obtain access to and request corrections of any personal information held by the School concerning them.

FEES PROTECTION POLICY – International Students

Rationale

International Student fees must be handled in a way that ensures those funds are accessed in a way that is consistent with normal accounting practice.  This means that those funds are secure from misappropriation and are only made available to the school in accord with the Refunds Policy or should the school not be able to continue tuition.

Purpose

1. To ensure that if in the event that the school is unable to continue to run a course or programme that the unspent portion of the fees are available to be returned to the student.
2. To ensure that funds from international students are accounted for separately and in such a way that individual student contributions can be protected and monitored.
3. To ensure that international students’ payment may be drawn down in accord with the Refund Policy.

Guidelines

1. Accounting procedures are in place to ensure that monies are available for release.
2. International fees shall be paid into the school’s separately coded account for ‘Foreign Fees’, and drawn down at intervals of one term in arrears throughout the academic year.
3. These monies will be audited separately on an annual basis.
• These monies will be available for approved refunds resulting from withdrawal from Papatoetoe Intermediate School or in the event of Papatoetoe Intermediate  School not being able to provide tuition.

REFUND CONDITIONS FOR INTERNATIONAL STUDENTS

If a student withdraws from his/her course of study before the completion date, he/she may be eligible for a refund of tuition fees.  If a refund is requested, the following procedures and guidelines will apply:

To be eligible for a Refund:
• To be eligible for a refund, parents must apply in writing to the Board of Trustees setting out the special circumstances of the claim within one month of the last day of attendance.  You must also complete the official leaving process and attach the leaving certificate.
• In every case, the school undertakes to look fairly at applications for a refund of fees or part-fees.

If the application is made before the start of the course:
• Fees will be refunded in full, less an Administration Fee of $ 400.00 . This includes if a student is not granted a student permit to attend Papatoetoe Intermediate School

If the application is made after the start of the course (e.g. in Terms 1 or 2), but before the second half of the course (e.g. Terms 3 & 4):

Fees will be refunded less:  
• An Administration Fee of NZ $400.00
• Costs to the school already incurred for tuition
• Components of the fee already committed for the duration of the course
• Specialist fees (if applicable)
• Appropriate proportions of salaries for teachers and support staff (if applicable)
• Costs already incurred for the use of facilities and resources
• Any other costs already incurred.

If the application is made after the second half of a course:
• There will be no refund, except under exceptional circumstances.  (See Compassionate Refunds below.)

• In exceptional circumstances, refunds may be granted on compassionate grounds (e.g. death of a close family member, serious illness, accident). All such refunds will be at the discretion of the Principal and the Board of Trustees.

If an international fee-paying student gains residency during their course:

• No further fees are to be paid. The new resident will then abide by the school enrolment scheme.  Documentation of residency must be provided within 14 days of it being granted.

 

The Board of Trustees will make no refund:
• When a student is required to leave the school for a breach of the rules and conditions of enrolment at the school or has broken a New Zealand law.
• Where a student has been stood-down, suspended or excluded
• Where a student returns home for any reason other than serious illness, accident or death of a close family member
• If the enrolment application is found to be inaccurate in any way and the contract is terminated
• If a student wants to transfer to another school or educational institution

Payment of Refunds:
• All refunds will be paid to either the parents of the student or to an agent with written authority from the parents.  No refunds will be given directly to the student.

Fees Protection: 
• The School has a fee protection policy to safeguard the fees paid by International Students, in the unlikely event that the school may not be able to continue delivering tuition to the international student.  This policy ensures that the school retains sufficient funds to meet the requirements of any refund in these circumstances.

N.B.  The New Zealand Immigration Service will be notified if any student ceases to attend (name of school) for whatever reason.

STAGE ONE: Problem Identification

Class teacher has concerns about a student’s learning and/or welfare.  This may be indicated by:
- Lowered performance in class
- Unexplained absences
- Behavioural concerns.

CODE REQUIREMENTS:

Section 9.1: Signatories must review all information provided to prospective international students at least annually to ensure its accuracy and relevance.

Section 9.2: The annual review of information must be recorded in a form that can be made available to the Administrator if requested.
